Terms and Conditions of Park & Fly Lda.
(as in June 2010)

Dear customer,

in order that we may offer you cost-efficient parking service including shuttle to your terminal at Faro airport and back at all times, certain procedures relating to the services provided by us have to be followed.

Therefore, we ask you to read and understand the following terms and conditions prior to signing the contract. We are pleased to welcome you as a prospective customer of Park & Fly Lda.

A) General
All services offered by the company Park & Fly Lda. are subject to these Terms and Conditions. Applicable is exclusively the version effective at the date the contract is concluded. When booking our services yet at the latest when entering the premises of Park & Fly Lda. the customer accepts the present Terms and Conditions which may be perused on our website www.parkandflyfaro.com.

Range of Services
a) Park & Fly Lda. engage to provide one or several parking spaces close to Faro airport and basic exterior cleaning as well as battery and tyre checks before pickup.

b) A free shuttle service will take the customers to the departure terminal and meet them at the arrival terminal at all times. The shuttle service is available on all days of the week not excluding public holidays or weekends.

Pickup by Park & Fly Lda. will take place promptly after arrival. The customer agrees to be picked up, in particular cases, by a shared transport and that this may delay the pickup time.

In the course of shuttle services to and from the airport terminals the customers of Park & Fly Lda. may be subjected to waiting times in case of events that are beyond the influence of Park & Fly Lda., i.e. a large number of persons to be transferred or delayed aircraft arrivals. These waiting times may add up to half an hour in exceptional cases.

Under any circumstances, Park & Fly Lda. reserve the right to carry out shared transportation which might lead to waiting times for the individual customer. Normally and as far as possible transportation to the departure terminal will be handled within 30 minutes max.
Provisions for Use of Premises
On the Company's premises, the customer of Park & Fly Lda. shall comply with the traffic regulations. The customer must obey the instructions of Park & Fly Lda.'s personnel.

The customers of Park & Fly Lda. are obligated to duly lock their vehicles and secure them according to common practice.

The vehicles shall be parked on the designated spaces.

Parking of defect vehicles, storage of fuels and other combustible material is absolutely prohibited. Vehicle repair and maintenance is likewise not allowed on the premises. Damages due to contravention are on the customer's account. Damages caused by a leaking tank are also on the customer's account.

Smoking is not permitted on the premises.

B) Contracts with Park & Fly Lda.
All contracts concluded with Park and Fly Faro are legally binding and effective.

1. Non-binding Offer
The offers Park & Fly Lda. make on their website www.parkandflyfaro.com or by means of flyers, commercials, advertisements or other media is non-committal. The offer becomes binding when Park & Fly Lda. confirm the reservation request.

2. Subject-matter of the Contract
Subject of the contracts concluded with Park & Fly Lda. is the confirmed reservation request. It exclusively covers the parking and the shuttle service to Faro airport and back subject to the prior notification of the departure and arrival time. Park & Fly Lda. disclaim the right to further services.

3. Conclusion of a Reservation
A contract with Park & Fly Lda. is only concluded after the confirmation has been confirmed. The confirmation will generally be issued in writing within 24 hours after a reservation request.

Customers are entitled to a vehicle parking space and the shuttle service only after their reservation has been confirmed by Park & Fly Lda.

4. Cancellation by the Customer
Customers may cancel the contract concluded between Park & Fly Lda. and themselves as above up to 48 hours before the appointed time, free of cost for them.

If the customer cancels the reservation later or fails to appear, the full parking fee will be charged to the customer's account, irrespective of the reasons. We reserve the right to charge an appropriate additional service fee should costs arise.

C) Park & Fly Lda.'s Liability
1. Liability for Motor Vehicle losses
Parking a car on one of the spaces provided by Park & Fly Lda. is solely at the customer's risk.

The Company assumes no liability whatsoever in case a vehicle suffers a damage during the time it is parked on the premises. Park & Fly Lda. also do not assume any liability for fire damages, third party damages or car theft off the premises during the parking time.

Under no circumstances are Park & Fly Lda. liable for accidents with bodily injuries or property damages caused on the premises by the driver, the customer or a third party. Park & Fly Lda.'s drivers are liable for any damages caused by them.

Park & Fly Lda. also assume no liability for any damages occurring during car maintenance and/or battery and tyre checks.

Please note:
The entire premises of Park & Fly Lda. are subject to the road traffic regulations. Driving faster than walking speed is not permitted. This applies to the driver(s) of Park & Fly Lda. as well as to any other driver(s).

2. Liability for Bodily Injuries
Park & Fly Lda. do not assume any liability for bodily injuries occurring on the premises of the Company or in the course of the shuttle service, self-inflicted or otherwise.

3. Liability for Baggage Damage/Loss of Baggage
Park & Fly Lda. cannot be held liable for damages to or loss of the customers baggage occurring on the Company's premises, self-inflicted by the customer or otherwise.

Please note:
You are never to leave your luggage unattended.

4. Liability for Late Arrival at the Departure Terminal
Park & Fly Lda. are not liable for a late arrival at the departure terminal in the sense that a flight cannot be met. This applies in the event of force majeure and also if the customer arrives late at Park & Fly Lda's premises.

The customer has to report to the personnel of Park & Fly Lda. immediately after arriving on the premises. Late arrivals of more than 10 minutes must be reported immediately. Otherwise, a reliable and orderly service cannot be provided.

5. Liability if Given False Data
Park & Fly Lda. are not liable if the customer gives false or incorrect data when booking. Due delivery and pickup can then not be granted. Additional costs may arise. In this case, the customer is not entitled to make demands.

D) Safety Regulations
For safety and organisational reasons the car key has to be deposited with Park & Fly Lda. The car key will be kept safely. In case of an emergency and the like, the vehicle must be accessible and removable.

If a customer fails to turn in the car key, the customer is liable for costs entailed in a required removal of the car in cases of emergency or the like. Park & Fly Lda. is not liable for any damages resulting therefrom.

E) Prices and Terms of Payment
1. Prices
The prices issued by the Company are subject to change and become legally binding only after the reservation request has been confirmed.

The prices issued by the Company include a value added tax of 21 %.

2. Terms of Payment
The parking fee covers one vehicle at a time. Arrival and departure time are each charged as one day. The full parking fee has to be paid in cash after parking the vehicle on Park & Fly Lda.'s premises. Park & Fly Lda. reserves a lien on the parked vehicle until the due amount is fully paid.

F) Special Agreements
Special agreements and variations of the Terms and Conditions must be made in writing.

G) Alterations of the Terms and Conditions
The Terms and Conditions of Park & Fly Lda. are valid as from 2010/06/01 until cancelled. Modifications of individual terms do not affect the unaltered provisions under the Terms and Conditions.

Invalidity of individual terms does not implicate invalidity of the entire Terms and Conditions. The statutory provisions apply in lieu of the invalid terms.
